Project Cancellation Policy – PariBekh INFRAWORKS
PariBekh INFRAWORKS understands that circumstances may change during a construction project. This policy establishes a general framework for project cancellation.
Cancellation by Client
A client may request cancellation by providing written notice to PariBekh INFRAWORKS.
Cancellation will be subject to:
- The signed project agreement
- Work already completed
- Materials already purchased
- Labour and mobilisation costs
- Approved third-party expenses
- Design and consultancy work already performed
- Outstanding payments
- Any applicable contractual cancellation charges
Cancellation Before Work Starts
If a client cancels before physical work begins, PariBekh INFRAWORKS will assess the refundable amount after deducting legitimate costs already incurred, such as design work, site visits, planning, procurement, administrative expenses or other agreed costs.
Cancellation After Work Begins
If cancellation occurs after construction or other project work has commenced, the client shall be responsible for payment for work completed and costs already incurred up to the effective cancellation date.
Materials purchased specifically for the project may also be charged to the client where applicable.
Immediate Suspension
PariBekh INFRAWORKS may suspend work where:
- Payments remain overdue.
- Required approvals are not provided.
- The site becomes unsafe.
- The client materially changes the agreed scope without approval.
- Required access to the site is unavailable.
- Continuing work would violate applicable law or safety requirements.
Reasonable notice will be provided where practicable.
Cancellation by PariBekh INFRAWORKS
PariBekh INFRAWORKS may terminate or suspend a project where the client materially breaches the project agreement, fails to make required payments, provides unsafe working conditions, or otherwise prevents the agreed work from being reasonably performed.
Any settlement following cancellation will be handled according to the project agreement and applicable law.
Final Settlement
Following cancellation, the parties shall determine:
- Value of work completed
- Materials supplied or procured
- Outstanding payments
- Approved additional work
- Refund, if any
- Handover of relevant documents/materials, where applicable
Project Re-commencement
If a cancelled or suspended project is later restarted, PariBekh INFRAWORKS may revise the quotation and timeline based on prevailing material, labour and other project costs.
Force Majeure
Cancellation, suspension or delay caused by circumstances beyond reasonable control will be dealt with according to the applicable project agreement and applicable law.
Disputes
The parties should first attempt to resolve cancellation-related disputes through direct communication and, where appropriate, mutually agreed mediation or other dispute-resolution mechanisms.
Any signed quotation, work order, agreement or contract may contain additional or more specific cancellation provisions for a particular project.
